Contract
Expectation. All clients are expected to book through the booking site or booking link and sign the contract before session confirmation. If, for any reason, client and photographer book through a third party, client and photographer shall follow the full contract. If client pays retainer, partial, or full payment through a third party, alternate site, or cash - client and photographer will abide by all contract rules.
Retainer and Payment. Client agrees to pay photographer a retainer at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. If there is a balance, it is due at the time of the session or pay in full before session if client chooses.
Cancellation. No refunds will be given for cancellation, but you may transfer your session to another party or use your credit on file for a future session. In case of inclement weather, Photographer will schedule a new shoot date for you with both schedules and weather in mind.
Late Arrivals. Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session. If available, the session may be pushed to a later time. It is extremely important that you arrive early/on time for your alotted time that you choose.
Re-shoots/Refunds. Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up or hair related issues or by not following the recommendations of the photographer. Re-shoots are allowed up to 3 rescheduled dates from beginning contact before client is considered a full cancellation. If client reschedules more than 3 times, and still cannot find time for a session, all session opportunities and fees paid are forfeit without consideration.
NO REFUNDS will be given for clients disliking images, weather, edits, etc. Please remember you chose this photographer when booking from the social media link. If you are unaware of this photographers style please look back at the social media photos to view the style before booking. If you like a certain style and think this photographer can accomplish this, please ASK before booking.
NO Refunds will be given by the photographer.
Artistic Rights. The Photographer retains the right of discretion in selecting the photographic materials released to the client.
Archive. After three (3) months, all ordered images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. All photos not ordered will be deleted to make room.
Photographic Materials. All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. Gallery proofs shall be available to the Client within 2-3 weeks of the session.
Copyright and Reproductions. The Photographer owns the copyright for all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio. If the Photographer desires to make other uses. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Photographer in the event of litigation arising out of such use. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102} without the written permission of the Photographer.
Client’s Usage. The Client shall only use the prints, including digital files, in accordance with the permissions within this agreement. The Client’s prints are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorize any reproductions by parties other than the Photographer. If the Photographer provides a digital file print release, the Client must act in accordance with the release. Client may NOT add filters, presets, etc. on top of photos recieved.
Model Release. I grant permission for Jessi Staggs Photography, to take and use; printed or electronic publications, websites, or other electronic communications, media, advertising, promotion, marketing, and packaging for any products or service. I further agree that my name and identity may be revealed in text or commentary in connection with the image(s). I authorize the use of the images without compensation to me. All negatives, prints, digital reproductions shall be the property of Jessi Staggs Photography. Model Release approval must be made by a parent/guardian if any photo session participants are less than 18 years of age. I agree that this release is irrevocable, worldwide and perpetual. I have read and fully understand this information in this model release. I agree this model release is for everyone involved in the session.
Session Requests
*No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer.
